Delta 8 THC is an isomer of hemp extract. Delta 8 THC is not Delta 9 THC which is a cannabinoid from the cannabis plant that does have a psychoactive affect when consumed and is illegal in quantities above .3% on a dray weight basis. Delta 8 THC is not marijuana. While the two share many similar properties, such as reportedly stimulating appetite, reducing nausea, and soothing pain, delta-8-THC tends to exhibit a lower psychotropic potency than Delta 9 THC when inhaled. When ingested, however, delta-8-THC can deliver the same intoxicating effects as Delta 9 THC. So be mindful when trying delta-8-THC edibles for the first time and use the same caution you would with delta-9-THC edibles.
The 2018 Farm Bill defines hemp as Cannabis sativa L. and “any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers,” with no more than a 0.3 percent concentration of THC.

Statute 18K defines "industrial hemp": means the plant Cannabis sativa L. and any part of the plant, whether growing or not, including the plant's seeds, and all the plant's derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. Industrial hemp is not marijuana as defined in section 152.01, subdivision 9.
